1 - ACCEPTANCE OF TERMS
This Terms of Use ("TOU") applies to your use of the OutSystems' services, including the access to a variety of resources such as developer tools, download areas, communication forums and product information through OutSystems' network of Web properties (including any updates, enhancements, new features, and/or the addition of any new Web properties) and other content that OutSystems makes available from time to time (the "Services"). OutSystems reserves the right to change these Terms from time to time without notice in its sole and absolute discretion. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our Web pages. By accessing and using our Services, you are agreeing to these TOU. "OutSystems" means OutSystems- Software em Rede, S.A., whose registered head office is at Rua Central Park, Ed. 6, 2.ºA, 2795-242 Linda-a-Velha, Portugal.
2 - CONFIDENTIALITY AGREEMENT
1. You agree that you shall maintain strictly confidential, and shall not reveal nor by any means transfer to a third party, or use any and all information related to the Services, products, materials, and prototypes, and any technical documentation that forms part of the Know-how of OutSystems, or that it has received from third parties, or any other information to which you have access by virtue of accepting these TOU.
2. You shall not make unauthorized copies of magnetic support or of product manuals relating to software products which belong to OutSystems, or which have been supplied to it by third parties.
3. You accept that OutSystems shall be the owner of any and all copyright or patent, or any other Intellectual Property right related to, and resulting from your access to OutSystems information, whatever the nature or form this may take, whether developed alone or in conjunction with OutSystems, or with any other entity or individual, in relation to commercial, professional or research activities, organized by OutSystems.
3 - PERSONAL AND NON-COMMERCIAL USE LIMITATION
Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, rent or sell any information, software, products or services obtained from the Services.

5 - NOTICE SPECIFIC TO SOFTWARE AVAILABLE ON THIS WEB SITE
Any software that is made available to download from the Services ("Software") is the copyrighted work of OutSystems. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). An end user will be unable to install any Software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms.
The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE OR BY OTHER WRITTEN CONSENT FROM OUTSYSTEMS.
6 - NOTICE SPECIFIC TO DOCUMENTS AVAILABLE ON THIS WEB SITE
Permission to use Documents (such as white papers, press releases, datasheets and FAQs) from the Services is granted, provided that (1) the below copyright notice appears in all copies and that both the copyright notice and this permission notice appear, (2) use of such Documents from the Services is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and (3) no modifications of any Documents are made. Accredited educational institutions, such as universities, private/public colleges, and state community colleges, may download and reproduce the Documents for distribution in the classroom. Distribution outside the classroom requires express written permission. Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

ALL SUCH DOCUMENTS AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. OutSystems HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL OutSystems BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION AVAILABLE FROM THE SERVICES.
THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED ON THE SERVICES COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. OutSystems MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE PRODUCT(S) AND/OR THE PROGRAM(S) DESCRIBED HEREIN AT ANY TIME.
7 - NOTICES REGARDING SOFTWARE, DOCUMENTS AND SERVICES AVAILABLE ON THIS WEB SITE
IN NO EVENT SHALL OutSystems BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.
8 - MEMBER ACCOUNT, PASSWORD, AND SECURITY
If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. Password will be provided by the Services and must be changed by you. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify OutSystems immediately of any unauthorized use of your account or any other breach of security. OutSystems will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by OutSystems or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
9 - NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any OutSystems server, or the network(s) connected to any OutSystems server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any OutSystems server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. The TOU, and your relationship with OutSystems, is governed by the laws of Portugal. You and OutSystems agree to submit any legal matter arising from the TOU to the exclusive jurisdiction of the courts of Lisbon, Portugal. Notwithstanding this, you agree that OutSystems shall still be allowed to apply for injunctive remedies in any jurisdiction.
10 - USE OF SERVICES
The Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable you to communicate with others (each a "Communication Service" and collectively "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using the Communication Services, you will not:
Use the Communication Services in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same.
Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages.
Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Restrict or inhibit any other user from using and enjoying the Communication Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
Harvest or otherwise collect information about others, including e-mail addresses.
Violate any applicable laws or regulations.
Create a false identity for the purpose of misleading others.
Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof.
OutSystems has no obligation to monitor the Communication Services. However, OutSystems reserves the right to review materials posted to the Communication Services and to remove any materials in its sole discretion. OutSystems reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever.
OutSystems reserves the right at all times to disclose any information as OutSystems deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in OutSystems' sole discretion.
Always use caution when giving out any personally identifiable information about yourself or your family in any Communication Services. OutSystems does not control or endorse the content, messages or information found in any Communication Services and, therefore, OutSystems specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Services. Managers and hosts are not authorized OutSystems spokespersons, and their views do not necessarily reflect those of OutSystems.
Materials uploaded to the Communication Services may be subject to posted limitations on usage, reproduction and/or dissemination; you are responsible for adhering to such limitations if you download the materials.
11 - MATERIALS PROVIDED TO OutSystems OR POSTED AT ANY OutSystems WEB SITE
OutSystems does not claim ownership of the materials you provide to OutSystems (including feedback and suggestions) or post, upload, input or submit to any Services or its associated services for review by the general public, or by the members of any public or private community, (each a "Submission" and collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting ("Posting") your Submission you are granting OutSystems a royalty-free, worldwide, irrevocable and perpetual license to use your Submission in connection with the operation of their Internet businesses (including, without limitation, all OutSystems Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; to publish your name in connection with your Submission; and the right to sublicense such rights to any supplier of the Services.
No compensation will be paid with respect to the use of your Submission, as provided herein. OutSystems is under no obligation to post or use any Submission you may provide and OutSystems may remove any Submission at any time in its sole discretion.
By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these TOU and the Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these TOU, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these TOU, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images. By Posting Images, you are granting (a) to all members of your private community (for each such Images available to members of such private community), and/or (b) to the general public (for each such Images available anywhere on the Services, other than a private community), permission to use your Images in connection with the use, as permitted by these TOU, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Images without having your name attached to such Images, and the right to sublicense such rights to any supplier of the Services. The licenses granted in the preceding sentences for a Images will terminate at the time you completely remove such Images from the Services, provided that, such termination shall not affect any licenses granted in connection with such Images prior to the time you completely remove such Images. No compensation will be paid with respect to the use of your Images.
12 - SOFTWARE AND CONTENT AVAILABLE ON THE OUTSYSTEMS WEB SITE
Software (if any), specific materials, information, products or services, materials and content that are made available to download from the OutSystems Web Site, excluding software that may be made available by end-users through a Communication Service, (collectively, "Content") is the copyrighted work of OutSystems and/or its suppliers. Your use of the Content is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Content ("License Agreement"). You may not install or use any Content that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. Content is owned by OutSystems and/or its suppliers and is protected by copyright laws and international treaty provisions. Any reproduction outside the scope of the License Agreement or redistribution of the Content is expressly prohibited by law and by this ToU.
13 - LINKS TO THIRD PARTY SITES
THE LINKS IN THIS AREA WILL LET YOU LEAVE OutSystems SITE. THE LINKED SITES ARE NOT UNDER THE CONTROL OF OutSystems AND OutSystems IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE OR ANY LINK CONTAINED IN A LINKED SITE, OR ANY CHANGES OR UPDATES TO SUCH SITES. OutSystems IS NOT RESPONSIBLE FOR WEBCASTING OR ANY OTHER FORM OF TRANSMISSION RECEIVED FROM ANY LINKED SITE. Outsystems IS PROVIDING THESE LINKS TO YOU ONLY AS A CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ENDORSEMENT BY OutSystems OF THE SITE.
14 - UNSOLICITED IDEA SUBMISSION POLICY
OutSystems OR ANY OF ITS EMPLOYEES DO NOT ACCEPT OR CONSIDER UNSOLICITED IDEAS, INCLUDING IDEAS FOR NEW ADVERTISING CAMPAIGNS, NEW PROMOTIONS, NEW PRODUCTS OR TECHNOLOGIES, PROCESSES, MATERIALS, MARKETING PLANS OR NEW PRODUCT NAMES. PLEASE DO NOT SEND ANY ORIGINAL CREATIVE ARTWORK, SAMPLES, DEMOS, OR OTHER WORKS. THE SOLE PURPOSE OF THIS POLICY IS TO AVOID POTENTIAL MISUNDERSTANDINGS OR DISPUTES WHEN OutSystems PRODUCTS OR MARKETING STRATEGIES MIGHT SEEM SIMILAR TO IDEAS SUBMITTED TO OutSystems. SO, PLEASE DO NOT SEND YOUR UNSOLICITED IDEAS TO OutSystems OR ANYONE AT Outsystems. IF, DESPITE OUR REQUEST THAT YOU NOT SEND US YOUR IDEAS AND MATERIALS, YOU STILL SEND THEM, PLEASE UNDERSTAND THAT OutSystems MAKES NO ASSURANCES THAT YOUR IDEAS AND MATERIALS WILL BE TREATED AS CONFIDENTIAL OR PROPRIETARY.
15 - INTELLECTUAL PROPERTY
OutSystems retains all right, title, and interest in and to its Web Site, Services and the Software (and any copies thereof), and in all related copyrights, trade secrets, patents, trademarks, and any other intellectual and industrial property and proprietary rights, including registrations, applications, renewals, and extensions of such rights. You are not granted any rights to any trademarks or service marks of OutSystems. Nothing in this TOU shall be interpreted to grant (by implication or otherwise) any license or rights to you except as expressly stated herein and/or in the License Agreement. You hereby grant to OutSystems a royalty-free, worldwide, irrevocable, perpetual license to use and incorporate into the Software, Services and/or in the OutSystems' Web Site any suggestions, enhancement requests, recommendations or other feedback provided by you to OutSystems, relating to the Software, the Services and/or the OutSystems' Web Site. Any rights not expressly granted herein are reserved.

1 - 利用条件への同意

3. お客様は、お客様がOutSystemsの情報にアクセスしたことに関連する、またその結果として生じたすべての著作権、特許、知的財産権について、その性質や形態を問わず、また、単独で開発されたか、OutSystemsと共同で開発されたか、OutSystemsによって組織された商業的活動、専門的活動、または研究的活動に関連する他の団体または個人と開発されたかにかわらず、OutSystemsが所有者であることを認めるものとします。
3 - 私的および非商用目的の利用への制限
別途定める場合を除き、本サービスはお客様が私的かつ非営利目的で利用するために提供されます。お客様は、本サービスを通じて入手した情報、ソフトウェア、製品、またはサービスを改変、複製、配布、送信、表示、実行、複製、公開、使用許諾、派生物の作成、譲渡、賃貸または販売することはできません。

本サービスにおいてダウンロード用に提供されているすべてのソフトウェア（以下「本ソフトウェア」）は、OutSystemsが著作権を有するものです。本ソフトウェアの使用には、本ソフトウェアに添付された、または本ソフトウェアに付帯している使用許諾契約書（以下「使用許諾契約書」）の条項が適用されます。お客様は、使用許諾契約書が添付されている、または付帯しているソフトウェアについては、使用許諾契約書の条項に同意したうえでのみ、インストールすることができます。ソフトウェアの試用にあたっては、https://www.outsystems.com/legal/trial-terms/にあるソフトウェア試用許諾契約書の条項が適用されます。
本ソフトウェアはお客様が使用許諾契約書に従って使用することを前提として、ダウンロード用に提供されています。使用許諾契約書に従わない本ソフトウェアのいかなる複製または再配布も法律によって明示的に禁止されており、これに違反した場合、民事上および刑事上の厳しい処罰の対象となる場合があります。違反者は、可能な限りにおいて訴追されることとなります。
前述の内容に限らず、本ソフトウェアに付属する使用許諾契約書によって、または書面でのOutSystemsの同意によって再複製や再配布が明示的に許諾されている場合を除き、再複製または再配布する目的で本ソフトウェアを他のサーバーまたは他の場所に複写または複製することは明示的に禁止されています。

本サービスより提供される各種ドキュメント（ホワイトペーパー、プレスリリース、データシート、FAQなど）の使用は、（1）すべてのコピーに下記の著作権表示があり、著作権表示と本許諾表示の両方が表示されていること、（2）本サービスより提供される各種ドキュメントの使用が情報提供目的かつ非営利または私的な用途でのみ使用され、ネットワークコンピュータへの複製もしくは配信、またはメディアを介した放送を行わないこと、および（3）ドキュメントに一切の変更を加えないことを条件に許諾されます。私立大学や国公立大学などの認定教育機関は、ドキュメントをダウンロードして複製し、教室内で配布することができます。教室外での配布には、書面による明示的な許可が必要です。また、他の目的に利用することは法律によって明示的に禁止されており、これに違反した場合、民事上および刑事上の厳しい処罰の対象となる場合があります。違反者は、可能な限りにおいて訴追されることとなります。
前述のドキュメントには、OutSystemsのWebサイトのデザインおよびレイアウトは含まれません。OutSystemsのWebサイトを構成している要素は、トレードドレス、商標、不正競争、および他の法律によって保護されており、そのすべてまたは一部をコピーまたは模倣することはできません。OutSystemsが明示的に許可した場合を除き、OutSystemsのWebサイトのロゴ、グラフィック、音声、または画像をコピーまたは転送することは禁じられています。
OutSystemsは、いかなる目的であっても、本サービスの一部として公開されているドキュメントおよび関連グラフィックに含まれている情報の適合性を表明するものではありません。当該ドキュメントおよび関連グラフィックはすべて現状のまま提供されており、いかなる保証も行いません。OutSystemsでは、本情報に関して、明示的、黙示的を問わず、あるいは法律の規定にかかわらず、その商品性、特定の目的に対する適合性、権原および非侵害における保証および条件も含めて、一切保証をするものではありません。OutSystemsは、いかなる場合においても、契約上の行為であるか、過失またはその他の不法行為であるかにかかわらず、本サービスで提供されている情報の利用や機能に起因または関連する使用不能、データの消失、利益の損失が原因で生じた特別損害、間接損害、派生的損害、その他いかなる損害についても一切責任を負いません。
本サービスで公開されるドキュメントおよび関連グラフィックには、技術的に不正確な記述または表記上のミスが含まれている可能性があります。当該情報には定期的に変更が加えられています。OutSystemsは、本Webサイトに掲載されている製品またはプログラムの改善や変更を随時行うことがあります。
7 - このWebサイトで入手可能なソフトウェア、ドキュメント、サービスに関する注意事項
OutSystemsは、いかなる場合においても、契約上の行為であるか、過失またはその他の不法行為であるかにかかわらず、本サービスで提供されているソフトウェア、ドキュメント、サービスの提供または不提供、あるいは情報の利用や機能に起因または関連する使用不能、データの消失、利益の損失が原因で生じた特別損害、間接損害、派生的損害、その他いかなる損害についても一切責任を負いません。
8 - メンバーアカウント、パスワード、セキュリティ
本サービスのいずれかにおいてアカウントの新規作成を求められた場合、お客様は、適用される登録用フォームに最新の完全かつ正確な情報を入力し、登録の手続きを完了させる必要があります。パスワードは本サービスによって提供されますが、お客様が変更する必要があります。お客様のパスワードとアカウントの機密保持に関する全責任は、お客様が負うものとします。また、お客様のアカウントから生じるすべての活動に関する全責任についても、お客様が負うものとします。お客様は、お客様のアカウントの不正使用またはその他のセキュリティ侵害があった場合、ただちにOutSystemsに通知することに同意するものとします。OutSystemsは、お客様側の認識の有無にかかわらず、お客様のパスワードまたはアカウントを第三者が使用したことによってお客様が被った損失について、一切責任を負いません。一方、他のユーザーがお客様のアカウントまたはパスワードを使用したことが原因でOutSystemsまたはその他の者が被った損失について、お客様が責任を負う場合があります。お客様は、いかなる場合も他のユーザーのアカウントを、その所有者の許可なく使用することはできません。
9 - 違法または禁止されている利用方法
本サービスの利用条件として、お客様は、違法な目的または本規約の条項、条件、注意事項で禁止されている目的のために本サービスを使用しないものとします。お客様は、OutSystemsのサーバーまたはOutSystemsのサーバーに接続しているネットワークを損傷したり、使用不能にしたり、過度な負荷を加えたり、害を及ぼしたりするような方法、または他のユーザーによる本サービスの使用を妨害する可能性のある方法で本サービスを利用することは禁じられています。お客様は、ハッキング、パスワードマイニング、またはその他の手法で、本サービス、他のアカウント、およびOutSystemsのサーバーまたは本サービスに接続しているコンピュータシステムやネットワークに対して不正なアクセスを試みることは禁じられています。お客様は、本サービスにおいて提供することが意図されていない手段により、素材や情報を取得する、あるいは取得を試みることは禁じられています。本規約、およびお客様とOutSystemsとの関係は、ポルトガルの法律に準拠します。お客様とOutSystemsは、本規約から生じたすべての法的問題の専属管轄裁判所をポルトガルのリスボンの裁判所とすることについて、合意するものとします。ただしお客様は、OutSystemsが任意の管轄区域において差し止めによる救済の申請が可能であることに同意するものとします。
10 - サービスの利用
本サービスには、メールサービス、掲示板サービス、チャットスペース、ニュースグループ、フォーラム、コミュニティ、個人のWebページ、カレンダー、フォトアルバム、ファイルストレージのほか、お客様と他のユーザーとのコミュニケーションのために設計されたメッセージまたはコミュニケーション機能（以下 「コミュニケーションサービス」）が含まれる場合があります。お客様は、特定のコミュニケーションサービスに関連する適切なメッセージおよび素材を投稿、送信、受信する目的に限ってコミュニケーションサービスを利用することに同意するものとします。たとえば、お客様がコミュニケーションサービスを利用する場合、次のような行為は禁止されています（ただし、これらに限定されません）。
商業目的の有無を問わず、アンケート、コンテスト、マルチ商法、チェーンメール、迷惑メール、スパムメッセージ、または無差別に発信するメッセージや不要なメッセージを送信すること。
他のユーザーに対して誹謗中傷、嫌がらせ、攻撃、ストーカー行為、脅迫を行うこと、または第三者の法的権利（プライバシーの権利、肖像権など）を侵害すること。
不適切、冒涜的、誹謗中傷、わいせつまたは違法な話題、名称、素材、または情報を公開、投稿、アップロード、配布、または頒布すること。
お客様が権利を保有もしくは管理しているか、または必要な許諾をすべて得ている場合を除き、著作権法または商標法を含む (ただしこれらに限定されない) 知的財産法またはプライバシーの権利もしくは肖像権によって保護されている画像、写真、ソフトウェアその他の素材を含むファイルをアップロードまたはその他の方法で利用可能な状態におくこと。
画像や写真など、本サービスを通じて提供される素材または情報を、他のユーザーの著作権、商標権、特許権、企業秘密、またはその他の所有権を侵害する方法で使用すること。
ウイルス、トロイの木馬、ワーム、時限爆弾型マルウェア、キャンセルボット、破損したファイル、または他のユーザーのコンピュータの動作や他のユーザーの財産に損害を与える可能性があるその他のソフトウェアやプログラムを含むファイルをアップロードすること。
コミュニケーションサービスにおいて明示的に許可された場合を除き、営業目的で商品やサービスを宣伝する、または販売もしくは購入を申し出ること。
コミュニケーションサービスの他のユーザーが投稿したファイルを、その複製、表示、実行、配布が違法であることを知りながら、または知っていると考えるのが合理的な状況でダウンロードすること。
アップロードされたファイルに含まれるソフトウェアやその他素材の作者の属性、法的またはその他の適正表示、所有権の指定、ソフトウェアの出所やソースのラベルなどの著作権管理情報を改ざんまたは削除すること。
他のユーザーによるコミュニケーションサービスの利用および享受を制限または禁止すること。
特定のコミュニケーションサービスに適用される可能性のある行動規範またはその他のガイドラインに違反すること。
メールアドレスなど第三者に関する情報を収集すること。
適用される法律または規制に違反すること。
他のユーザーを欺く目的で身元を偽ること。
本サービスのユーザーのディレクトリまたはユーザーや使用状況に関する情報もしくはその一部を、使用、ダウンロード、コピーする、または個人や団体に対して（有償・無償を問わず）提供すること。
OutSystemsは、コミュニケーションサービスを監視する義務を一切負いません。ただし、OutSystemsは、コミュニケーションサービスに投稿された素材を確認し、独自の裁量で任意の素材を削除する権利を有します。OutSystemsは、いかなる理由によっても、予告なくいつでもお客様によるコミュニケーションサービスの一部またはすべての利用を停止する権利を有します。
OutSystemsは、適用法、規制、法的手続き、もしくは政府からの要請に応えるうえで必要と判断する場合には、情報を開示する権利、および情報または素材のすべてまたは一部をOutSystems独自の裁量で編集、投稿拒否、または削除する権利を常に有します。
コミュニケーションサービスでお客様ご自身やご家族の個人情報を提供する場合は、常に慎重を期してください。OutSystemsは、コミュニケーションサービスに掲載されているあらゆるコンテンツ、メッセージ、情報の管理または保証を行いません。したがって、OutSystemsはコミュニケーションサービスに関して、また、お客様がコミュニケーションサービスに参加したことで生じた訴訟についていかなる責任も負いません。サービスの管理者や運営者の見解は、OutSystemsの見解を必ずしも代弁し、反映しているとは限りません。
コミュニケーションサービスにアップロードされた素材は、使用、複製、または頒布に関して制限が課される場合があります。お客様は、素材をダウンロードする際に、当該制限に従うものとします。
11 - OutSystemsに提供された素材およびOutSystemsのWebサイトに投稿された素材
OutSystemsは、お客様がOutSystemsに提供した素材（ご意見、ご感想を含む）、または一般利用者の閲覧用またはパブリックコミュニティもしくはプライベートコミュニティのメンバーの閲覧用に本サービスもしくはその関連サービスに投稿、アップロード、入力もしくは送信した素材（以下「提出物」）に対する知的財産権を主張しません。ただし、提出物を投稿、アップロード、入力、提供または送信（以下「投稿」）することにより、お客様はOutSystemsに対し、各インターネットビジネス（すべてのOutSystemsサービスを含むが、これに限定されない）の運営に関連して、お客様の提出物を使用するための世界全域を対象とした無償、取消不能、かつ永久の使用許諾を付与することになります。これには、お客様の提出物をコピー、配布、送信、公に展示、公に上映、複製、編集、翻訳・翻案もしくはフォーマット変更する権利、お客様の提出物に関連してお客様の名前を公表する権利、および当該権利を本サービスのサプライヤーに再許諾する権利などが含まれますが、これらに限定されるものではありません。
本使用条件に定めるお客様の提出物の使用に関しては、いかなる対価も支払われません。OutSystemsは、お客様が提供した提出物を掲載する義務も使用する義務も負いません。
また、OutSystemsは独自の裁量で提出物をいつでも削除することができます。お客様は、提出物を投稿することにより、本規約に記載されている提出物に対するすべての権利（提出物をお客様が提供、投稿、アップロード、入力、または送信するために必要なすべての権利が含まれるが、これらに限定されない）をお客様が保有または管理していることを保証し、表明するものとします。
上記の保証および表明に加えて、画像、写真、絵画が含まれ、あるいは一部またはすべてがグラフィカルな提出物（以下「 本画像」）を投稿することによって、お客様は、以下のことを保証し、表明したものとします。（a）お客様自身が本画像の著作権者であること、または本画像の著作権者がお客様に対して、本画像または本画像に含まれるコンテンツや画像を、お客様の使用方法および目的に合致した、本規約および本サービスで別途認められた方法で使用することを許可していること、（b）お客様が本規約で定める許諾および再許諾を付与するために必要な権利を有すること、（c）本画像内に人物が描かれている場合に、その人物が、本規約に定める本画像の使用（本画像の配布、公の展示および複製を含むが、これらに限定されない）に同意していること。お客様は、本画像を投稿することにより、（a）お客様のプライベートコミュニティのすべてのメンバーに対して（当該プライベートコミュニティのメンバーが利用可能な本画像について）、および（b）一般利用者に対して（プライベートコミュニティを除く本サービス上のいずれかの場所で利用可能な本画像について）、本規約で認められた本サービスの使用（本画像を含む印刷物や贈答品の作成を含むが、これらに限定されない）に関連して、お客様の本画像を使用する許可を付与することになります。これには、お客様の氏名を付さずにお客様の本画像をコピー、配布、送信、公に展示、公に上映、複製、編集、翻訳・翻案およびフォーマット変更する、非独占的で、世界全域を対象とする無償の使用許諾、および当該権利を本サービスのサプライヤーに再許諾する権利が含まれますが、これらに限定されません。前述の本画像に関する許諾は、お客様が本サービス上から本画像を完全に削除したときに終了するものとしますが、お客様が本画像を完全に削除する前に本画像に関して付与された許諾は、終了の影響を受けずに存続するものとします。お客様の画像の使用に関しては、いかなる対価も支払われません。
12 - OutSystemsのWeb サイトで利用可能なソフトウェアおよびコンテンツ
コミュニケーションサービスを介してエンドユーザーから提供されるソフトウェアを除き、OutSystemsまたはOutSystemsのサプライヤーは、OutSystemsのWebサイトからダウンロード可能なソフトウェア（ある場合）、特定の資料、情報、製品/サービス、素材およびコンテンツ（以下「コンテンツ」）の著作権を有します。コンテンツの使用には、コンテンツに添付された、または付帯している使用許諾契約書（以下「使用許諾契約書」）の条項が適用されます。お客様は、使用許諾契約書に添付された、または付帯しているコンテンツを、使用許諾契約書の条項に同意した場合にのみインストールすることができます。ソフトウェアの試用にあたっては、https://www.outsystems.com/legal/trial-terms/にあるソフトウェア試用許諾契約書の条項が適用されます。コンテンツはOutSystemsまたはOutSystemsのサプライヤーが所有し、著作権法および国際協定の条項によって保護されています。使用許諾契約書の範囲外でコンテンツを複製/再配布することは、法律および本規約によって明示的に禁止されています。
13 - 第三者サイトへのリンク
このエリアのリンクをクリックすると、OutSystemsのサイトを離れます。リンク先のサイトはOutSystemsの管理下にはないため、OutSystemsは、リンク先サイトのコンテンツやリンク先サイトに含まれるリンク、またはそれらサイトの修正や更新に関して責任を負いません。OutSystemsは、動画配信やその他の形態でリンク先サイトから送信される情報に対して責任を負いません。OutSystemsは、お客様の便宜のためにのみこれらのリンクを提供しており、リンクの記載によって、リンク先のサイトをOutSystemsが推奨していることを意味するものではありません。
14 - アイデアのご提供に関するポリシー
OutSystemsまたはOutSystemsの従業員は、OutSystemsが要請したものではないアイデア（新規の広告キャンペーンや販売促進、新製品や新技術、プロセス、素材、マーケティング計画や新製品名などに関するアイデアを含む）のご提供をお断りしており、ご送付いただいても検討することはありません。独自に創作されたアート作品、サンプル、デモやその他作品などの送付はご遠慮ください。このポリシーは、OutSystemsの製品やマーケティング戦略が、OutSystemsに提供されたアイデアと類似しているように見えるために生じる誤解や紛争を避けるために設けられています。そのため、OutSystemsから要請のない限り、お客様のアイデアをOutSystemsやOutSystemsの従業員にご提供いただくことは控えていただくようお願い申し上げます。このポリシーにもかかわらず、アイデアや素材をお送りいただいた場合、OutSystemsが当該アイデアや素材を機密としても専有財産としても扱う保証はないことをご了解ください。
15 - 知的財産
OutSystemsは、OutSystemsのWebサイト、サービス、およびソフトウェア（およびそれらのコピー）、ならびに関連するすべての著作権、企業秘密、特許、商標、およびその他すべての知的財産権と工業所有権および所有権に対するすべての権利、権原、および利益を有します（当該権利の登録、申請、更新、および延長を含みます）。お客様は、OutSystemsの商標またはサービスマークに対する権利を一切付与されていません。本規約または使用許諾契約書に明示的されている場合を除き、本規約のいかなる内容も使用許諾や権利を（黙示またはその他の方法によって）お客様に付与するものと解釈されないものとします。お客様は本規約により、本ソフトウェア、本サービスまたはOutSystemsのWebサイトに関連してお客様がOutSystemsに提供した提案、機能強化の要求、推奨事項、その他の意見や感想を、本ソフトウェア、本サービス、およびOutSystemsのWebサイトで使用および適用することができる、世界全域を対象とした無償、取消不能、かつ永久の使用許諾をOutSystemsに付与するものとします。本規約で明示的に付与されていない権利はすべて留保されています。
OutSystemsおよびOutSystemsのロゴは、OutSystemsの登録商標です。商標に関する情報については、OutSystemsまでお問い合わせください。
